Business Migration — Critical 2026 Update

Subclass 188 Visa – Business Innovation and Investment Visa Australia

Australia's Business Migration Pathway — What You Must Know in 2026

Before anything else, there is something critically important you need to know about the Subclass 188 visa. As of 31 July 2024, the entire Business Innovation and Investment Program (BIIP) is closed to new applications. This closure affects all streams — Business Innovation, Investor, Significant Investor, and Entrepreneur.

However, this page remains critically important for two groups. First, existing Subclass 188 holders who need to understand their obligations, extension options, and pathway to permanent residency through the Subclass 888. Second, business owners, entrepreneurs, and investors who need to understand what alternative pathways are available in 2026.

At Migration Republic, our MARA-registered migration agents assist existing Subclass 188 holders with their ongoing obligations, extension applications, and Subclass 888 permanent residency transition — as well as advising new business migrants on the alternative pathways now available.

Critical Program Update

The Subclass 188 Is Closed — What This Means for You

Closed — 31 July 2024

No New Applications Accepted

The Department of Home Affairs will not accept any new applications for the BIIP (Subclass 188) visa. No new Expressions of Interest are being accepted. No new state or territory nominations are being processed for new 188 applications. If you did not lodge before 31 July 2024, the Subclass 188 is not available to you.

The new National Innovation Visa (Subclass 858) introduced in late 2024 is now the primary pathway for entrepreneurs and investors.

If You Already Hold a Subclass 188

  • Your application will be processed under the rules that applied at the time of submission
  • Extension applications (Business Innovation and Significant Investor streams) are still being accepted
  • Applications for the permanent Subclass 888 are still being accepted
  • Your path to permanent residency remains open — but compliance management is critical
  • A 2-year extension is possible once you have held the 188 for 3 years

If You Are a New Business Migrant

  • The Subclass 188 is no longer available to you
  • The National Innovation Visa (Subclass 858) is the primary replacement pathway — permanent residency for exceptional achievers
  • Skilled migration (Subclass 189/190) remains available for professionals wanting to start businesses as permanent residents
  • Regional pathways (Subclass 491 → 191) may suit entrepreneurs open to regional Australia
  • Professional advice is essential — the landscape has changed fundamentally

Visa Overview

What Was the Subclass 188 Visa?

The Business Innovation and Investment Visa (Subclass 188) was a provisional visa designed for individuals seeking to establish or manage a new or existing business in Australia or invest in the country. Introduced in 2012, it enabled successful applicants to live, work, and study temporarily while committing to business activities, with a pathway to permanent residency via the Subclass 888 visa after meeting specific milestones.

The visa operated as a provisional (temporary) visa, typically valid for five years, with permanent residency accessible through the Subclass 888 once the holder demonstrated sufficient compliance with their stream's business or investment obligations.

What the Subclass 188 Allowed Holders to Do

  • Own and manage a business in Australia
  • Conduct business and investment activity in Australia
  • Undertake entrepreneurial activity in Australia
  • Include spouse or de facto partner and dependent children in the application
  • Live, work, and study in Australia during the visa period
  • Access Australia's public education system and Medicare
  • Travel in and out of Australia freely during visa validity
  • Transition to permanent residency via Subclass 888

Why the Program Closed

Why Was the Subclass 188 Closed?

Understanding why the program closed helps clarify what Australia is looking for from business migrants going forward — and what this means for the alternative pathways now available.

The closure of BIIP followed a 2023 review which found that the overall economic contribution of some BIIP visa holders was lower than expected. The Migration Review found that the BIIP was delivering poor economic results for Australia — supported by findings from the Treasury and the Productivity Commission.

The core criticism was that the program, particularly the Business Innovation stream, was not consistently producing the economic outcomes it was designed to create. Some visa holders were meeting the minimum technical requirements without genuinely contributing to Australian innovation, job creation, or economic productivity at the level the program intended.

The Policy Shift: Talent Over CapitalThe Government's view is that attracting the right kind of talent — people who genuinely drive innovation and economic growth — matters more than attracting capital alone. The National Innovation Visa (Subclass 858) launched on 6 December 2024 reflects this shift — it is a permanent visa for exceptional talent in key sectors, not a capital-based investment pathway.

Historical Streams Reference

The Five Streams That Existed Under the Subclass 188

For existing 188 holders — your stream determines your obligations, extension eligibility, and Subclass 888 pathway requirements. Understanding which stream you hold is essential for planning your permanent residency transition.

Stream 188A

Business Innovation Stream

For established business owners aged 55 or under with a track record of successful business ownership. State or territory nomination required. Minimum 65 points in the points test. Genuine intention to establish or participate in a business in Australia.

Stream 188B

Investor Stream

For people willing to make a designated investment of at least AUD $1.5 million into an Australian state or territory. State or territory nomination required. Minimum 65 points in the points test. Investment must be maintained in designated complying investments.

Stream 188C

Significant Investor Stream

Required a minimum AUD $5 million investment in complying Australian investments. No age restriction and no points test. Investment must be held across venture capital, emerging company, and managed funds under a structured investment framework.

Stream 188D

Premium Investor Stream

Required a minimum AUD $15 million investment in complying premium investments. Invitation-only through Austrade on behalf of the Australian Government. The rarest stream — reaching only a handful of applicants annually.

Stream 188E

Entrepreneur Stream

Required a funding agreement from a third party of at least AUD $200,000 for a complying entrepreneur activity. State or territory nomination required. Entrepreneurial activity must focus on innovation in sectors such as technology, healthcare, and advanced manufacturing. Unlike other streams, this was less about capital and more about innovation potential and the quality of the business idea being commercialised.

For Existing 188 Holders

Current Status for Existing Subclass 188 Holders

If you already hold a Subclass 188 visa or had a pending application lodged before 31 July 2024, your situation is different from that of new applicants. Applicants who submitted a Subclass 188 application before 31 July 2024 will have their applications processed under the rules that applied at the time of submission — and these applications will not be cancelled.

What Is Still Being Accepted

  • Applications for the Business Innovation Extension stream for current 188 holders
  • Applications for the Significant Investor Extension stream for current 188 holders
  • Applications for secondary criteria for the Subclass 188
  • Applications for the permanent Subclass 888 visa filed by Subclass 188 holders — including those granted before 31 July 2024

Extension and Refund Rules

  • Extension: A 2-year extension is possible once you have held the 188 for 3 years — giving 6 years from the date of grant of the original visa
  • Extension applications must be lodged through ImmiAccount and require state or territory nomination in most cases
  • Refunds: Available for applicants of Business Innovation, Investor, Significant Investor, or Entrepreneur streams who withdraw on or after 31 July 2024
  • Refunds are NOT applicable for extension streams
Compliance Complacency Is the Most Common FailureFor existing 188 holders: missing a business activity threshold, a residency requirement, or a state nomination deadline can close your permanent residency pathway entirely — after years of living and investing in Australia. Active management of your obligations from the very first day of your provisional visa is essential. Do not assume everything is on track without a proper compliance review.

Permanent Residency Pathway

The Pathway to Permanent Residency — Subclass 888

For existing Subclass 188 holders, the Subclass 888 Business Innovation and Investment (Permanent) visa is the destination. Subclass 188 holders and their families can continue on this pathway after July 2024 if they hold an active Subclass 188 visa and meet the eligibility criteria.

Once granted, the Subclass 888 gives you permanent residency — indefinite stay rights, no business conditions, ability to sponsor family, access to social benefits, and a pathway to Australian citizenship.

What Compliance for the Subclass 888 Requires

  • Continued operation of or investment in qualifying Australian business or investment activities
  • Meeting residency obligations — time spent in Australia during the provisional visa period
  • Demonstrating ongoing business performance or investment maintenance
  • State or territory nomination for the 888 in many cases
  • Health and character requirements for all applicants and included family members
Review Your Compliance Status NowThe compliance requirements are strict — investment maintenance, residency obligations, business activity thresholds. Miss one and your pathway to permanent residency closes. Book a consultation and review exactly where you stand before your visa conditions become a problem.

Alternative Pathways — 2026

What Replaced the Subclass 188 — Alternative Pathways in 2026

For anyone who missed the July 2024 deadline, there is no longer a direct equivalent of the Subclass 188. But there are meaningful alternative pathways depending on your profile, background, and goals.

01

National Innovation Visa (Subclass 858) — The Primary Replacement

The National Innovation Visa (Subclass 858) introduced in late 2024 is now the primary pathway for exceptional entrepreneurs and investors — offering direct permanent residence. Unlike the 188, the NIV uses evidence-based assessments — patents, publications, industry recognition — without investment minima, targeting the top performers in global innovation. For genuinely world-class entrepreneurs whose achievements can be independently verified through patents, company exits, investment rounds, or international recognition, the NIV is the most direct permanent residency pathway available.

02

Skilled Migration (Subclass 189/190)

If your background includes skills in an occupation on Australia's skilled lists, the points-tested skilled migration pathways remain fully open. These visas allow skilled professionals to migrate and subsequently establish businesses in Australia as permanent residents. They do not directly address business migration but provide a stable permanent residency platform from which to operate a business.

03

Skills in Demand Visa (Subclass 482) via Employer Sponsorship

For those with the right occupation profile, establishing an Australian entity and sponsoring a position through a legitimate employer-sponsored pathway may be possible — but this is complex and requires careful structuring with professional guidance. It is not a straightforward business migration pathway.

04

Skilled Work Regional (Subclass 491 → 191)

For entrepreneurs willing to invest in regional Australia through employment and business activity, the regional skilled pathway offers a route — though it is less direct than the former BIIP. State nomination in a regional area is required, and the 491 leads to permanent residency through the Subclass 191 after three years of regional compliance.

All streams — Business Innovation, Investor, Significant Investor, and Entrepreneur — stopped accepting new applications. If you did not lodge before this date, the Subclass 188 is not available to you.

I lodged before 31 July 2024 — what happens to my application?
Your application will be processed under the rules that applied at the time of submission. However, you may experience delays due to changes in migration priorities and processing timelines. Your application will not be cancelled.
Q

Refunds are available for applicants of the Business Innovation, Investor, Significant Investor, or Entrepreneur streams who withdraw their applications on or after 31 July 2024. However, refunds are not applicable for extension streams.

I hold a Subclass 188 — can I still apply for the Subclass 888?

Q
What replaced the Subclass 188?
The National Innovation Visa (Subclass 858) introduced in late 2024 is the primary pathway for entrepreneurs and investors. Unlike the 188, it prioritises exceptional talent, industry impact, and innovation over financial investment. It offers direct permanent residence for those who qualify.

A 2-year extension is possible once you have held the Subclass 188 for 3 years — giving 6 years from the date of grant of the original visa. Extension applications require lodgment through ImmiAccount and state nomination in most cases. Only Business Innovation and Significant Investor extension streams remain available.
Q
What is the points test score needed for the Business Innovation and Investor streams?
You must score at least 65 points (the pass mark) in the points test to be eligible for the Business Innovation stream or the Investor stream. The points test does not apply to the Significant Investor stream, the Premium Investor stream, or the extension streams.
Q

Yes — successful visa holders can include their spouse, children, and other dependents in the application, allowing them to live, work, or study in Australia. Family members must also meet health and character requirements.

Why Migration Republic

Why Choose Migration Republic?

The closure of the Subclass 188 has created two very different groups of people who need guidance — and both face complex, high-stakes decisions.

For existing 188 holders, the path to permanent residency through the Subclass 888 is still open — but the compliance requirements are precise, state nomination processes vary significantly, and the window between your provisional visa expiry and your 888 application is not one to manage casually. Missing a business activity threshold, a residency requirement, or a state nomination deadline can close your permanent residency pathway entirely after years of living and investing in Australia.

For new business migrants, the landscape has changed fundamentally. The 188's straightforward capital-based pathway no longer exists. The National Innovation Visa demands exceptional achievement, not just investment. Understanding which of the remaining pathways best fits your profile — and building the strongest possible application for it — requires current, specific expertise.

At Migration Republic, our MARA-registered migration agents have experience across the full spectrum of business migration — from 188 compliance management and 888 applications for existing holders, to NIV EOI strategy and alternative pathway assessment for new business migrants.
