The Subclass 888 Pathway Remains Fully Open for Existing Subclass 188 Holders
On 31 July 2024, the Australian Government permanently closed the Business Innovation and Investment Program to new applicants. This means no new Subclass 188 applications can be lodged. However, the pathway to permanent residency through the Subclass 888 remains fully intact for existing Subclass 188 holders. Applications for the Subclass 888 by Subclass 188 holders — including those whose provisional visas were granted from applications lodged before 31 July 2024 — can continue to be lodged and will be processed.
Current Subclass 188 holders in the Business Innovation or Significant Investor streams can still apply for extension streams if they need additional time to meet the Subclass 888 criteria. What is the Subclass 888 Visa?
The Subclass 888 Business Innovation and Investment (Permanent) Visa is a permanent visa that allows holders of a Subclass 188 Business Innovation and Investment (Provisional) Visa to continue their business and investment activities in Australia indefinitely. It is the permanent residency destination for business migrants who entered Australia under the BIIP framework.
The Subclass 888 is not a standalone application that any business owner can lodge. It is specifically a transition visa — it requires the applicant to already hold, or to have held, an eligible Subclass 188 provisional visa in a qualifying stream. The Subclass 888 requires both approval from the Department of Home Affairs and a valid state or territory government nomination.

The Five Streams of the Subclass 888
The Subclass 888 has the following streams, each corresponding to the stream of the applicant's Subclass 188 provisional visa:
Business Innovation Stream
For Subclass 188 holders who have established or managed a business in Australia and can demonstrate the required turnover, assets, and employment creation.
Investor Stream
For Subclass 188 holders who have maintained a designated investment of at least AUD $2.5 million for the life of their provisional visa and have been present in Australia for at least two of four years.
Significant Investor Stream
For Subclass 188 holders who have maintained a complying investment of at least AUD $5 million throughout the provisional visa period and met the prescribed residency requirements.
Entrepreneur Stream
For Subclass 188 holders who undertook complying entrepreneurial activity in Australia — an innovative project leading to the commercialisation of a product or service or development of a new business.
Premium Investor Stream
For Subclass 188 holders who made complying premium investments of at least AUD $15 million. This stream was nominated through Austrade.
Eligibility and Financial Requirements
Who Can Apply — Eligibility and Key Financial Thresholds
Eligibility for the Subclass 888 is governed by two layers of requirements — the federal Department of Home Affairs criteria, which apply to all streams, and the state or territory nomination criteria, which vary between states and between streams. Both must be met.
Universal Requirements — All Streams
- Hold an eligible Subclass 188 provisional visa in the relevant stream — the Subclass 188 must not have been cancelled and the state or territory nomination must remain valid
- Have met the specific requirements of the stream in which the Subclass 188 was granted
- Have a current state or territory government nomination for the Subclass 888
- Have met health and character requirements
- Have a genuine and realistic intention to continue business or investment activities in Australia
Business Innovation Stream (888A) — Key Financial Thresholds
Annual business turnover of at least AUD $300,000 in the 12 months before applying, plus at least two of the following three requirements:
Investor Stream (888B)
- Maintained a designated investment of at least AUD $2.5 million with an Australian state or territory for the life of the Subclass 188B visa — usually four years
- Been present in Australia for at least two of the four years of the provisional visa period
Significant Investor Stream (888C)
- Maintained a complying investment of at least AUD $5 million throughout the entire Subclass 188C provisional visa period
- Met the prescribed residency requirements — at least 40 days per year or at least 180 days in the final year
Role Swapping — Secondary Holder Becomes Primary Applicant
If the secondary applicant under the Subclass 188 has taken the lead in managing business or investment activities, the secondary applicant can become the primary applicant for the Subclass 888. Role swapping is permitted in both the Business Innovation (888A) and Investor (888B) streams. Professional advice should be sought before lodging.

Unlike the provisional Subclass 188, the Subclass 888 carries no geographic restriction. Once granted, the holder can relocate their business, expand to new markets, or live wherever they choose across Australia.
Pathway to Australian Citizenship
After four years of lawful residence with at least one year as a permanent resident, Subclass 888 holders can apply for Australian citizenship. Time spent on the provisional Subclass 188 counts toward the four-year requirement.
Full Access to Medicare
From the date of grant, Subclass 888 holders and included family members have full access to Australia's public healthcare system — a significant improvement over the Subclass 188.
Bridging Visa Protection During Processing
If the applicant is in Australia when they lodge the Subclass 888 and their current Subclass 188 expires during processing, a Bridging Visa is automatically activated maintaining lawful status throughout the 20 to 27 month processing period.
