Business Innovation and Investment — Permanent Residency for Business Migrants
Subclass 888 Visa – Business Innovation and Investment (Permanent) Visa Australia
The Final Step for Business Migrants — Turning Provisional Business Status into Permanent Australian Residency
For business migrants who came to Australia through the Business Innovation and Investment Program, the journey was never meant to end with a provisional visa. The Subclass 188 was always a starting point — a structured period during which business owners and investors were expected to demonstrate genuine business activity, financial contribution, and commitment to Australia. The Subclass 888 Business Innovation and Investment (Permanent) Visa is where that provisional journey concludes.
The Subclass 888 is permanent residency for business. It recognises that the applicant has done what they came to Australia to do — they have run a business, created employment, maintained an investment, or commercialised an innovation — and that Australia's interests are served by making their residence here permanent.
There is a critical context every Subclass 888 applicant must understand in 2025 and 2026. The Australian Government permanently closed the Business Innovation and Investment Program (BIIP) to new applicants on 31 July 2024. The Subclass 888, however, remains fully open for existing Subclass 188 holders. At Migration Republic, our MARA-registered migration agents understand the complexity of business visa applications and are here to help you navigate the transition from provisional to permanent with precision and confidence.

Critical Update — 2024 BIIP Program Closure
The 2024 BIIP Closure — What It Means for Subclass 888 Applicants
The Subclass 888 Pathway Remains Fully Open for Existing Subclass 188 Holders
On 31 July 2024, the Australian Government permanently closed the Business Innovation and Investment Program to new applicants. This means no new Subclass 188 applications can be lodged. However, the pathway to permanent residency through the Subclass 888 remains fully intact for existing Subclass 188 holders. Applications for the Subclass 888 by Subclass 188 holders — including those whose provisional visas were granted from applications lodged before 31 July 2024 — can continue to be lodged and will be processed.
Current Subclass 188 holders in the Business Innovation or Significant Investor streams can still apply for extension streams if they need additional time to meet the Subclass 888 criteria. Family members of primary Subclass 188 holders can still apply under the secondary criteria. If you hold a Subclass 188 and are approaching eligibility for the Subclass 888, now is the time to begin preparing.
Visa Overview
What is the Subclass 888 Visa?
The Subclass 888 Business Innovation and Investment (Permanent) Visa is a permanent visa that allows holders of a Subclass 188 Business Innovation and Investment (Provisional) Visa to continue their business and investment activities in Australia indefinitely. It is the permanent residency destination for business migrants who entered Australia under the BIIP framework.
The Subclass 888 is not a standalone application that any business owner can lodge. It is specifically a transition visa — it requires the applicant to already hold, or to have held, an eligible Subclass 188 provisional visa in a qualifying stream. The Subclass 888 is then granted when the applicant can demonstrate that they have met the business, investment, and residency conditions of their provisional visa period.
The Subclass 888 requires both approval from the Department of Home Affairs and a valid state or territory government nomination. Both the federal and state components must be satisfied before the visa can be granted.
Key Features of the Subclass 888 Visa
- Permanent visa — live, work, and study anywhere in Australia indefinitely
- Transition from Subclass 188 provisional visa — not available to new applicants outside the system
- Stream-specific — must match the stream of the applicant's Subclass 188
- Requires both Department of Home Affairs approval and state/territory nomination
- Five-year travel facility from date of grant
- Full access to Medicare and government services
- Right to sponsor eligible family members
- Pathway to Australian citizenship
- Bridging visa granted if application lodged while in Australia and current visa expires during processing
- Processing times currently range from 20 to 27 months due to BIIP backlog
- Role swapping permitted — secondary Subclass 188 holder can become primary Subclass 888 applicant
Visa Streams
The Five Streams of the Subclass 888
The Subclass 888 has the following streams, each corresponding to the stream of the applicant's Subclass 188 provisional visa:
Business Innovation Stream
For Subclass 188 holders in the Business Innovation stream who have established or managed a business in Australia during their provisional visa period and can demonstrate the required turnover, assets, and employment creation.
Investor Stream
For Subclass 188 holders in the Investor stream who have maintained a designated investment of at least AUD $2.5 million for the life of their provisional visa and have been present in Australia for at least two of the four years of the visa period.
Significant Investor Stream
For Subclass 188 holders in the Significant Investor stream who have maintained a complying investment of at least AUD $5 million throughout the provisional visa period and have met the prescribed residency requirements.
Entrepreneur Stream
For Subclass 188 holders in the Entrepreneur stream who have undertaken complying entrepreneurial activity in Australia — meaning an innovative project that led to the successful commercialisation of a product or service or the development of a new business — during their provisional visa period.
Premium Investor Stream
For Subclass 188 holders in the Premium Investor stream who have made complying premium investments of at least AUD $15 million. This stream was nominated through Austrade.
Eligibility and Financial Requirements
Who Can Apply — Eligibility and Key Financial Thresholds
Eligibility for the Subclass 888 is governed by two layers of requirements — the federal Department of Home Affairs criteria, which apply to all streams, and the state or territory nomination criteria, which vary between states and between streams. Both must be met.
Universal Requirements — All Streams
- Hold an eligible Subclass 188 provisional visa in the relevant stream — the Subclass 188 must not have been cancelled and the state or territory nomination from the provisional visa must remain valid
- Have met the specific requirements of the stream in which the Subclass 188 was granted — including business turnover, investment maintenance, residency, and employment creation conditions
- Have a current state or territory government nomination for the Subclass 888
- Not have been involved in business or investment activities considered unacceptable in Australia — including unlawful or fraudulent business practices
- Have met health and character requirements
- Have a genuine and realistic intention to continue business or investment activities in Australia — demonstrated through Form 1398 and a business plan submitted with the application
Business Innovation Stream (888A) — Key Financial Thresholds
To qualify under the Business Innovation stream, the applicant must demonstrate during the 12 months immediately before applying: annual business turnover of at least AUD $300,000 from the main business or businesses in Australia. In addition, at least two of the following three requirements must be met at the time of application:
The applicant must also have had an ownership interest and direct, continuous management role in the business for the two years immediately before applying. The primary applicant must have been physically present in Australia for at least 12 months cumulatively within two or three years before submitting the application, depending on the date of their Subclass 188A invitation.
Investor Stream (888B) — Key Requirements
- Maintained a designated investment of at least AUD $2.5 million with an Australian state or territory for the life of the Subclass 188B provisional visa — usually four years
- Been present in Australia for at least two of the four years of the provisional visa period
- Continued to hold the state or territory nomination
Significant Investor Stream (888C) — Key Requirements
- Maintained a complying investment of at least AUD $5 million throughout the entire Subclass 188C provisional visa period
- Met the prescribed residency requirements — at least 40 days per year in Australia during each year of the provisional visa, or at least 180 days in the final year
Role Swapping — Secondary Holder Becomes Primary Applicant
A key feature of the Subclass 888 framework that many applicants and their families are not aware of is the option of role swapping. If the secondary applicant under the Subclass 188 has taken the lead in managing the business or investment activities — rather than the primary applicant — the secondary applicant can become the primary applicant for the Subclass 888. Role swapping is permitted in both the Business Innovation (888A) and Investor (888B) streams. This provides meaningful flexibility for couples and business partners where circumstances have changed since the original Subclass 188 application. Professional advice should be sought before lodging.
Visa Benefits
Key Benefits of the Subclass 888 Visa
Permanent Residency — Earned Through Business Contribution
The Subclass 888 is not simply a reward for investing money in Australia. It represents recognition by the Australian Government that the applicant has genuinely contributed to the Australian economy — through business activity, employment creation, and investment — and that this contribution warrants the permanence of residency. For business migrants who have spent years building their Australian enterprise under a provisional visa, the Subclass 888 is the culmination of that investment of time, capital, and commitment.
Freedom to Live and Work Anywhere in Australia
Unlike the provisional Subclass 188, which came with state or territory obligations, the Subclass 888 carries no geographic restriction. Once granted, the holder can relocate their business, expand to new markets, or simply live wherever they choose across Australia. Full work rights across any business, any occupation, and any industry apply without restriction.
Pathway to Australian Citizenship
After meeting the standard residency requirements — four years of lawful residence in Australia with at least one year as a permanent resident — Subclass 888 holders can apply for Australian citizenship. Time spent in Australia on the provisional Subclass 188 counts toward the four-year requirement.
Full Access to Medicare
From the date of grant, Subclass 888 holders and included family members have full access to Australia's public healthcare system. This is a significant practical improvement over the Subclass 188, which had more limited healthcare access.
Right to Sponsor Family Members
Subclass 888 holders can sponsor eligible family members for permanent residence in Australia through the family stream of the migration program.
Bridging Visa Protection During Processing
If the primary applicant is in Australia when they lodge the Subclass 888, and their current Subclass 188 expires during processing, a Bridging Visa is automatically activated. This maintains lawful status throughout the 20 to 27 month processing period currently experienced under the reduced BIIP allocation.
Document Checklist
What Documents Do You Need for the Subclass 888?
The Subclass 888 is a documentation-intensive application. The quality and completeness of the evidence submitted directly determines the outcome. Alongside this, a business plan must be provided that demonstrates the applicant's genuine and realistic commitment to continuing business or investment activities in Australia after the visa is granted.
Business Innovation Stream (888A)
- Evidence of ownership interest and management role — company registration documents, ASIC records, shareholder agreements, employment contract or director appointment

- Business Activity Statements (BAS) lodged with the Australian Taxation Office
- Evidence of business assets — net business assets of at least AUD $200,000
- Combined personal and business asset evidence — if claiming the AUD $600,000 combined threshold

How We Help
Our Visa Process
Eligibility Assessment and Timeline Planning
The Subclass 888 application requires careful timing. We begin by reviewing the applicant's current Subclass 188 status, the stream under which it was granted, the conditions of the state or territory nomination, and the business or investment performance during the provisional visa period. We assess whether the eligibility criteria have been met, identify any gaps in documentation or compliance, and plan the application timeline to ensure the Subclass 188 and any Bridging Visa arrangements are properly managed throughout the 20 to 27 month processing period.
State Nomination Assessment and Preparation
Every Subclass 888 requires a valid state or territory nomination. We advise on whether the existing nomination from the Subclass 188 remains valid for the Subclass 888 application, whether any changes to business activity need to be disclosed and approved by the nominating state, and whether a new nomination application needs to be lodged. We prepare the state nomination application where required and coordinate the submission to ensure nomination and federal visa lodgement are properly sequenced.
Business Documentation and Financial Evidence Preparation
The financial evidence package is the foundation of any Business Innovation or Investor stream Subclass 888 application. We work with the applicant — and often with their accountants — to compile the right evidence of turnover, assets, investment maintenance, and employment creation. We ensure the evidence is presented clearly, covers the right time periods, and addresses every criterion the Department will assess.
Form 1398, Business Plan, and Full Application Preparation
We prepare Form 1398, draft a comprehensive business plan tailored to the applicant's specific stream and business, and compile the complete Subclass 888 application package. Every document is reviewed for accuracy, completeness, and consistency with the information previously provided to the Department during the Subclass 188 application process.
Post-Lodgement Monitoring and Bridging Visa Management
After lodgement, we monitor the application throughout the extended processing period. Where the applicant's Subclass 188 expires during processing, we advise on Bridging Visa conditions and ensure lawful status is maintained. We respond to any requests for additional information from the Department and keep the applicant informed throughout the process until a decision is issued.

Why Migration Republic
Why Choose Migration Republic?
The Subclass 888 is one of the most financially and legally complex visa applications in the Australian migration system. The standards are rigorous, the documentation requirements are substantial, and the stakes — for applicants who have invested years and significant capital into their Australian business ventures — could not be higher.
Getting the application wrong carries serious consequences. Business activity that has not been properly documented. A change in business direction that was not approved by the nominating state. Turnover or asset figures that do not meet the thresholds for the 12 months before lodgement. A residency period that has not been properly tracked. Any of these can result in refusal — after 20 to 27 months of waiting.
Our MARA-registered migration agents understand every layer of the Subclass 888 framework — the federal Department of Home Affairs criteria, the state and territory nomination requirements, the financial thresholds, the residency conditions, and the critical importance of documenting business activity accurately and completely. We work closely with applicants and their accountants to build application packages that present the business contribution clearly and compellingly.
State Nomination Expertise Across All Jurisdictions
Requirements have tightened in many jurisdictions since the BIIP closure. We understand what each state and territory requires for the Subclass 888 nomination, how to handle changed business circumstances, and how to coordinate the state and federal lodgement sequence correctly.

The financial evidence package is the foundation of every Subclass 888 application. We work directly with applicants and their accountants to compile turnover, asset, investment, and employment evidence that covers the right periods and meets every departmental criterion.
