AAT Fees Filing Fees for AAT Review

Lodging an application for merits review at the AAT requires payment of a prescribed application fee. Fees are set by the Migration Regulations and are indexed annually. The fee is payable at lodgement and must be paid before the application is accepted.

Fee Waiver Hardship Cases

A fee waiver or reduction is available in genuine financial hardship cases but it is not automatic. You must apply for it at the time of lodgement with supporting evidence of your financial circumstances. Hardship is assessed on a case-by-case basis. Do not assume you qualify apply specifically and provide clear documentation.

Fee Refunds

If the Department changes or sets aside the decision before the AAT makes its decision, the application fee may be refunded. Partial refunds may also be available in certain circumstances. The AAT does not refund fees simply because the review is unsuccessful an unfavourable Tribunal decision does not entitle you to a refund.

When a Refund May Be Available

  • The Department changes or sets aside its decision before the AAT issues its own decision
  • The application is withdrawn in specific circumstances before the hearing
  • Partial refund conditions are met as prescribed under the Migration Regulations
  • Not refundable: AAT affirms the decision against you an unsuccessful review does not attract a refund
  • Not refundable: You withdraw the application for personal reasons after the process has commenced
