What Is the Subclass 309/100 Partner Visa?

The Subclass 309 visa is a temporary offshore partner visa that enables the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. Subclass 309

Stage 2 — Permanent

Subclass 100

Approximately two years after your original lodgment date, the Department assesses your permanent stage. If your relationship remains genuine and ongoing, the Subclass 100 is granted — making you an Australian permanent resident. Some applicants may be granted the 100 directly, without the two-year wait.

Sponsorship Requirements

Your Australian partner must be approved as a sponsor before the Subclass 309 can be granted. The sponsorship is submitted as part of the combined 309/100 application — your partner lodges Form 40SP as sponsor, and you lodge Form 47SP as the applicant. To be approved, your partner must:

  • Be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen
  • Be at least 18 years of age
